1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Berceau Industries LLC governing your access to and use of the Gideon mobile application, web application, and website at berceauindustries.com (collectively, the "Service"). By creating an account, downloading, or using the Service, you agree to be bound by these Terms.

2. Eligibility

The Service is intended for users of all ages for educational purposes. If you are under 18, you represent that you have obtained parental or guardian consent. If you are under 13 (or under 16 in the EEA), you may only use the Service with verifiable parental consent.

3. Description of Service

Gideon is an adaptive study and knowledge retention platform that uses spaced repetition, mastery decay modeling, and evidence-based learning techniques to help users retain information effectively. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

4. Account Registration and Security

To access certain features, you must create an account. You agree to provide accurate information, maintain the security of your login credentials, and accept responsibility for all activities under your account. Each account is personal and may not be shared or transferred.

5. Acceptable Use

You agree to use the Service only for lawful purposes. You agree not to:

  • Attempt to gain unauthorized access to the Service or other accounts
  • Interfere with or disrupt the Service or its infrastructure
  • Use automated systems (bots, scrapers) without permission
  • Reproduce, sell, or exploit any portion of the Service
  • Upload malware or harmful code
  • Harass or abuse other users
  • Reverse engineer the Service or use it to develop competing products

6. Intellectual Property Rights

The Service and all its contents — including software, algorithms, text, graphics, logos, and design — are owned by Berceau Industries LLC and protected by intellectual property laws. Study content is licensed for your personal, non-commercial educational use only.

7. User Content

You retain ownership of content you create. By submitting content, you grant Berceau Industries a non-exclusive, worldwide, royalty-free license to use it solely for providing and improving the Service. This license ends when you delete the content or your account.

8. Subscriptions, Payments, and Refunds

  • Billing: Payment is charged to your App Store, Play Store, or Stripe account at purchase.
  • Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the current period ends.
  • Price Changes: Price changes take effect at the start of the next billing period.
  • Refunds: Handled through the respective app store's refund policy, or by contacting [email protected] for web purchases.

9. Educational Disclaimer

Gideon is a study aid and is not a substitute for formal education or professional advice. We do not guarantee any particular academic outcome. Study content may contain errors — users should verify critical information through official sources.

10. Termination

You may delete your account at any time through app settings or by contacting [email protected]. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. BERCEAU INDUSTRIES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BERCEAU INDUSTRIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. BERCEAU INDUSTRIES'S TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID IN THE PRECEDING 12 MONTHS OR $100.

13. Dispute Resolution

These Terms are governed by the laws of the State of New York. Before filing formal action, you agree to attempt informal resolution by contacting [email protected]. Unresolved disputes shall be resolved by binding arbitration administered by the AAA in New York.

YOU AND BERCEAU INDUSTRIES AGREE THAT EACH PARTY MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A CLASS MEMBER.

14. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated with at least 30 days' notice. Continued use of the Service constitutes acceptance of the updated Terms.
